2024 Arts & Crafts Fair Function Agreement

This agreement must be completed in order for your application for a booth to be considered. Deadline: August 13, 2024

THIS AGREEMENT CONTAINS A RELEASE FROM LIABILITY AND HOLD HARMLESS CLAUSE. PLEASE READ BEFORE SIGNING.

Upon receipt of good funds (if applicable) and acceptance into the fair, applicant agrees to the following:
The space assigned you may not be resold, rented, loaned, or shared by anyone other than the applicant without written permission of the Lexington Chamber of Commerce *
Applicant cancellations will be handled upon written notice to the Lexington Chamber of Commerce t our discretion. None will be accepted less than thirty (30) days in advance of the event. *
If you make a reservation and do not show up and do not provide written cancellation according to paragraph III, you are financially liable. *
Exhibitor space at the Lexington Chamber of Commerce Autumn Fine Arts & Crafts Festival will be assigned at the sole discretion of the Chamber. Special requests will be given consideration. *
Each exhibitor is responsible for providing all materials to set up their booth, including but not limited to: tables and chairs; signs; banners/name plates; a canopy or tent; pens; point of sale and cash box items. Electricity and WiFi connection are not provided. Any items for display or sale must fit within the exhibitor’s designated 10’x10’ space. If an additional space is needed, you may request that and pay a separate fee at the time of application. On the day of the event, exhibitors not following these rules will be required to remove any items that do not fit. Refusal to comply with these guidelines will result in termination from the fair without refunds. *
The applicant shall keep their space in good condition and assume full responsibility for any and all damages caused to said space. Applicant shall be responsible for final cleanup of said space. Applicant shall also assume full responsibility for any measures deemed necessary by the Lexington Board of Health. The Lexington Chamber of Commerce takes no responsibility to provide these materials. All vendors will be expected to conform to any health measures ordered by the Board of Health. Refusal to comply will result in immediate removal from the Fair without a refund of any fees paid. *
Release from liability: Applicant agrees to release the Lexington Chamber of Commerce, its officers, agents, servants, and employees from any and all liability due to loss, damage, or injury sustained either directly or indirectly in connection with the Chamber event, including COVID related risks or illnesses. Further, the applicant hereby releases and forever discharges the Lexington Chamber it's employees, and directors, either in their official capacity or in their individual capacity of and from all manner of contracts, judgments, damages, claims, or demands whatsoever in law or equity which may arise from any theft, loss, damage, or injury howsoever sustained directly or indirectly in connection with a Lexington Chamber of Commerce event. The Lexington Chamber, its officers and employees may plead this release and bar any claim, demand, or course of action instituted by the applicant. *
All applicants are required to carry their own insurance coverage for their material en route to and/or from, and at all times during the LCoC event, and insurance coverage for any and all loss, damage or injury sustained for "any" reason while at such event. *
The LCoC, at its sole discretion, may expel any applicant for conduct deemed to be detrimental to the event as a whole, or to the LCoC. In such case, the applicant shall forfeit any fees. *
The Lexington Chamber of Commerce will not invite a vendor to return the following year, if said vendor vacates assigned booth space before the designated closing time of the event. *
In the event that the Fair is cancelled due to weather or other causes, Applicant’s booth fee will be returned minus a $25 processing fee. *
I have read all terms and agree. By typing my name in the next section, I consider myself to have signed this agreement and shall abide by its terms. *
